The Court’s Panel Judges consist of Achmad Sodiki (Head of the Panel), Harjono and Ahmad Fadlil Sumadi (members of the Panel) examined the result of the North Konawe’s district re-election at the hearing of local electoral dispute, Thursday (10/2)


Jakarta MKonline-The Court opened the succeeding hearing on the dispute of local election in North Konawe District on Thursday (10/2). The case registered under Number 191/PHPU.D-VIII/2010 was scheduled to hear the re-election results in North Konawe District. Six pairs of the contestants at North Konawe District election are Abdul Hamid Basir and Tamrin Pawani, Mustari and Muh. Nur Sinapoy, Apoda and Kahar, Herry Asiku and Andhy Beddu D, Herry Hermansyah Silondae and Andi Syamsul Bahri, also Slamet Riadi and Rudin Lahadi.    

“Todays hearing is to hear the report from the local electoral commission which held the re-election. Also from the local electoral watch at district and provincial level, in addition the local observers  of the re-election” said judge Ahmad Sodiki.    

The Head of the local electoral commission of the Southeast Sulawesi Province explained the details of the votes at 15 TPS’s from 11 villages at North Konawe District. “At the local re-election of the Head and Deputy of North Konawe District 2011 were : Pair no.1 had 2,327 votes; pair no. 2 had 2 votes; pair no.3 had 1 vote; pair no.4 had 1 vote; pair no.5  had 1,814 votes; pair no.6 had 1 vote; pair no. 7 had 3 votes; pair no.8 had 1 vote. Moreover, the total of legal votes were 4,150.

In their report, the local electoral commission of North Konawe District as the defendant represented by the Head of the commission, Indra Supriyadi, had held the re-election in 15 TPS’s at 10 sub-district areas (kelurahan) and 11 villages in North Konawe District. “Furthermore, we also conducted disseminations with leaflets and stickers for the communities at the places where there’ll be held the re-election. Moreover, we also held Bimtek to PPK, PPS and KPPS on How to Vote and Count Ballots” uttered him.   

Meanwhile, Head of local election watch of North Konawe District, Hasran Abubakar, informed the oversight process of re-election. According to Hasran, there was no administrative error or omission on re-election in 11 villages at North Konawe District.     

“Nevertheless, there were reports from the public after the counting of the ballots. Reports from the public on omission were all regarding money-politics. There were 22 reports on flagrant and all were reporting on money-politic. The Local electoral watch pursued the lead from the public report and handed down to Coordinated Law Enforcement Center (Sentra Gakkumdu) with enclosed evidences. The flagrants, as much as 20 reports were repealed by the Gakkumdu to complete the evidence and witnesses testimonies. If the documents were completed, Gakkumdu will take some actions but if the documents cannot be completed the local election watch were recommended to withdraw the reports” he explained.   
Responding to the reports, the Petitioners especially pair no.3, 6, and 8 stated their objection through their Counsel, Arteria Dahlan . The Petitioners argued that there were extraordinary flagrants that took place and far greater than previous election. “the flagrants, serious omissions, on previous election were conducted directly by the winning pair, but on the re-election it involve their siblings too” he contended.

Judge Achmad Sodiki explained that he would bring the case to the Full Bench whether it would be continued or not. “Therefore, it is for Justices to examine thoroughly, I will report the case to the Full Bench in the Justice Plenary Session. Usually after re-election and we gave the opportunity for both parties to be heard in the Court session and what comes next is up to the Judges to decide” he uttered.   (Lulu Anjarsari/mh/bisar)
